Heather is a member of the Labor & Employment Group and Chair of the Immigration Group at Kaufman & Canoles. Her employment-based practice includes representation of employers in all aspects of employment disputes, from legal and policy compliance, to internal investigations, to administrative proceedings, to litigation. She has extensive experience successfully defending employers in discrimination cases in federal court and in defending employment arbitration cases. Heather’s immigration practice focuses on business immigration, including counseling and representation of employers and individuals in all aspects of compliance, temporary work authorization and permanent resident options.

  • Successfully defended employers in a myriad of discrimination cases, including race, sex, gender, religion, age, national origin, religion, and disability, from internal complaints, to EEOC charges, to litigation
  • Defended numerous EEOC charges related to various types of alleged discrimination, including race, sex, gender, religion, age, national origin, religion, and disability
  • Obtained numerous summary judgment decisions in employment matters in federal courts throughout the Southeast
  • Obtained summary judgment for local municipality in various employment discrimination cases
  • Successfully enforced arbitration provisions for national employers in numerous state and federal courts across the United States
  • Successfully defended national employers in employment-related arbitration cases across the United States
  • Obtained favorable results in wage and hour disputes
  • Obtained favorable results in unfair competition disputes, including the enforcement of covenants not to compete
  • Counseled employers with respect to FMLA and other leave issues
  • Represented employers in administrative investigations involving EEOC, DOL, ICE, and USCIS
  • Assisted employers in evaluating reduction in force and furlough options
  • Successfully obtained numerous employment-based temporary, non-immigrant visas for professional, executive, and/or management level employees, professors, and researchers
  • Successfully obtained numerous employment-based, permanent, immigrant visas for professional, executive,  and/or management level employees, professors, and researchers
  • Successfully obtained employment-based EB-1 outstanding professor/researcher status for individuals with limited publication and/or citation support
  • Successfully obtained employment-based EB-2 status, with national nterest waiver, for individuals
  • Performed internal audits for employers, with focus on I-9 compliance
  • Special counsel to the Commonwealth of Virginia for immigration matters, including the representation of state agencies, colleges and universities
