Landlord/Tenant Bankruptcy & Commercial Leases Seminar

Participants will gain a general overview on bankruptcy issues facing landlords and tenants in the commercial real estate context including the three main types of bankruptcy (chapters 7, 11 and 13). Topics covered include: (1) the automatic stay and how to avoid violations; (2) assumption and/or rejection of leases; (3) calculation of damages when a lease is rejected pre and post-petition; (4) 'stub rent;' (5) security deposits; (6) turnover; (7) landlords liens for distress; (8) proofs of claim and pitfalls in filing them; (9) credit reporting issues; and (10) guarantors and letters of credit as alternate means of recovery.
